This empty space, known as “slack-fill”, serves no lawful function and allows candy manufacturers like Nestlé to profit from lower production costs. Consumers do not receive the full benefits of what they paid for and are forced to accept this deception as the new normal.

This deceptive business practice not only threatens consumers but also other companies, large and small, who play by the rules. It stifles competition, disrupts the marketplace, and reduces consumer choice and mobility.

Plaintiffs Jade Thomas and Carey Hoffman found themselves victims of Nestlé’s packaging scheme but have chosen to fight back to change the status quo and make fair packaging the new normal.
